Terms of Use
Version v1 · Updated Oct 5, 2026
1. Who we are and what Versus is
Versus ("Versus", "we", "us") is a web app (PWA) where people vote on quick "this or that" polls, see what the community chose, and create and share their own polls. The service is free.
By creating an account or using Versus, you accept these Terms. If you do not accept them, do not use the service.
Legal notice:
- Publisher: Versus
- Host: Fly.io, Inc.
- Contact: hello@joinversus.co
If you have a question about these Terms, write to us at hello@joinversus.co.
2. Who can use Versus (age: 16 and over)
- Versus is for people aged 16 or older.
- When you sign up, you tick the box "I am 16 or older". This is a declaration. We do not check your age with a document or any other technical means, and we do not store any age at sign-up.
- Declaring an age that is not yours breaks these Terms. If we learn that an account belongs to someone under 16 (for example after a report), we delete it.
- If you are under 16, do not create an account. If you know of an account that belongs to someone under 16, report it with the Report button on their profile or write to us at hello@joinversus.co.
- If you are 16 or 17, you confirm that you can accept these Terms under the law that applies to you, or that you have your legal guardians' permission where that law requires it.
3. Your account
- To vote and to create a poll you need an account with a verified email address (6-digit code sent by email, valid for 10 minutes).
- You choose a username, which is public (shown on your polls and your public profile). Do not use a name that impersonates someone or breaks the content rules.
- Keep your password secret. You are responsible for what is done with your account. Tell us if you think it has been compromised.
- One person, one account. Creating several accounts to vote more than once on the same poll, or to get around a suspension, is forbidden.
- Your private profile (date of birth, profession, gender, country, region) is optional and is never shown publicly. How it is used is explained in the Privacy Policy and on the consent screen. An incomplete profile still lets you vote, but your votes do not count in group breakdowns until you have given your consent.
4. Votes and results
- A vote is final. You cannot change or withdraw it. One vote per person and per poll.
- Results come from people who chose to vote on Versus. They are not representative of any population and are not a statistical survey or an opinion poll within the meaning of French law no. 77-808 of 19 July 1977. Do not present a Versus result as a representative survey.
- Group breakdowns (age band, gender, profession, country) are shown only if the group is large enough and only from the votes of people who consented to it. They are statistics, never individual data.
- If you delete your account, your past votes stay in the totals but are detached from you (see section 10).
5. Content you publish
"Your Content" means the polls, questions, answers, images, covers, avatar and anything else you publish on Versus.
5.1 You stay the owner. We do not become the owner of Your Content.
5.2 Licence you give us. To run the service, you give Versus a worldwide, non-exclusive, free licence to host, store, display, reproduce, resize, compress, crop and share Your Content, and to generate preview images (for example for link sharing) that reuse the text of your polls. Our technical providers (hosting, storage, delivery network) may exercise this licence for the sole purpose of running the service. It lasts as long as Your Content is on the service.
5.3 What you guarantee. You confirm that:
- you own Your Content or have the rights and permissions needed to publish it (copyright, image rights, rights of the people shown);
- it does not break the law, anyone's rights or the content rules.
5.4 Photos and people. Do not upload photos of people you have no right to show. Never upload photos of children. Do not use photos taken by others (news agencies, TV screenshots, paparazzi) without the rights. Details: content rules.
5.5 After your account is deleted. Your avatar and your private profile are deleted, as well as the images of your polls (cover and answer images). Your polls stay online (texts and votes) without your username (shown as "Former member"), because other people voted on them. You can ask for a specific poll to be removed with the Report button or by writing to hello@joinversus.co.
5.6 Our own content. Versus also publishes its own polls. We do not use photos of celebrities in them.
6. Content rules
A Versus poll asks an opinion question, not an accusation. Versus is open to debate, humour and criticism, but the following are forbidden: serious accusations presented as facts, content targeting children or private individuals, explicit sexual content, harassment, hate and illegal content. The full rules are in the content rules, which are part of these Terms.
7. Reporting and removal
- You can report a poll or a profile with the Report button (reasons: inappropriate content, harassment, copyright, spam, other). A verified account is required.
- We review reports and may hide or delete content and warn, suspend or close an account, in particular if the rules are broken or if the law requires it. As a precaution, a poll may also be hidden automatically before review when several distinct people report it for the same reason; it is then reviewed and restored if it breaks nothing.
- We do not promise any response time: reports are handled by a small team. We do not check content before it is published and we do not promise to detect everything.
- When content is removed, we try to tell its author and give the reason when we can. You can write to us at hello@joinversus.co to ask for a new review.
- Copyright: to report content that infringes your copyright, follow the DMCA procedure. Accounts that repeatedly infringe copyright are closed.
- Image rights and privacy: if you appear in an image or are named in a poll and you object, report it or write to hello@joinversus.co.
8. Suspension and end of your account
We may suspend or close your account if you break these Terms or the law, or to protect the service or other users. You can stop using Versus and delete your account at any time from the settings (see section 10).
9. Availability of the service
Versus is provided "as is" and "as available", free of charge. We do what is needed to keep it running, but we do not guarantee continuous availability, an error-free service, or that a feature (for example the email with your verification code) always arrives on time. We may change, suspend or stop all or part of the service; if we stop the service, we will tell you in the app within a reasonable time.
10. Deleting your account and your data
You can delete your account from the settings (your password is asked). Before that, you can also download your data (JSON file) from the same settings. Here is what happens on deletion, in plain words (details in the Privacy Policy):
| Item | What happens |
|---|---|
| Account (username, email, password) | Deleted |
| Private profile (date of birth, profession, gender, country, region) and avatar | Deleted |
| Consent log | Deleted with the account |
| Your votes | Kept, detached from you (no link to you any more); they stay in the totals |
| Your polls | Kept (texts and votes), author shown as "Former member"; their images are deleted; removal of a specific poll on request |
| Reports you made | Kept, with no link to you |
| Backups | Your data may remain in encrypted backups for up to 6 months, then disappears |
11. Liability
- Nothing in these Terms excludes or limits a liability that cannot be excluded or limited by law, including your consumer rights and our liability for gross negligence or wilful misconduct.
- Subject to that, our liability to you is limited to direct and foreseeable damage, and we are not liable for indirect damage (for example a lost opportunity) linked to the use of a free service.
- Content published by users is the responsibility of those who publish it. Versus acts as a host of that content and removes it promptly when informed that it is manifestly unlawful, except for its own polls, for which we are responsible.
12. Changes to the Terms
We may update these Terms. If the change is significant, we will tell you in the app or by email at least 15 days before it takes effect where possible, and we may ask you to accept the new version again. The version in force is shown at the top of the page. If you disagree with the change, you can delete your account.
13. Language
These Terms exist in French and in English, with the same content. In case of a difference of interpretation, the French version prevails, without reducing the rights that the law of your country of residence gives you.
14. Governing law and disputes
These Terms are governed by French law. The mandatory consumer protection rules of your country of residence continue to apply. If you disagree with us, write to us first at hello@joinversus.co: we look for an amicable solution. Failing that, the competent courts are those determined by the applicable rules; if you are a consumer, you can also bring the matter before the courts of your place of residence. We do not impose arbitration or a waiver of class actions on you.
